    PACT ACT - Let's act! We can't let this pass.

    Some of you may remember H.R. 4081: 110th Congress, 2007-2008, The PACT Act. "To prevent tobacco smuggling, to ensure the collection of all tobacco taxes, and for other purposes." On Sep 10, 2008 7:41PM, this passed. 88% of the house (379 votes) approved it, and only 3% (12 votes) said no. With all present and 42 (10%) not voting on it. 2/3 of 391 votes (261) was required to pass it.

    Rep. Anthony Weiner, a Democrat from New York (the state with the highest tobacco taxes already, go figure), sponsered this. The stated purpose of this bill? "[to give] law enforcement new tools to crack down on smugglers of tobacco and curb illicit tobacco sales over the Internet." The real reason for this is MONEY. "By some estimates, New York state loses $1 billion from tobacco smuggling", Rep. Anthony Weiner stated. It would become a felony to sell tobacco [to the United States] and violate tax law in the United States. But it's okay. The rich big wigs can still have their cigars. They're exempt. The 110th Senate version? S.1027. (identical to HR 4081).

    And now....

    On March 23, 2009, a Bill was introduced in the the House of Representatives (HR 1676) by Congressman Anthony D. Weiner of New York, which was referred to the House Committee on the Judiciary. The Bill states, "To prevent tobacco smuggling, to ensure the collection of all tobacco taxes, and for other purposes." This will deem ALL cigarettes/smokeless tobacco non-mailable through USPS. FedEx, UPS and DHL have voluntarily agreed not to ship cigarettes. Failure to comply with state tax laws by any seller via telephone, mail, or internet would be a federal offense.

    May 21, 2009 1:53PM, this passed. 397 said yes (92% of the vote), 11 said no (only 3% of the vote) 25 didn't vote. They only needed 272 votes, which they of course received. This bill has passed the house and is waiting on to be voted on by the Senate.

    What does the "and for other purposes" in the bill mean? Regulating smokeless tobacco, as well as setting up a process of keeping track of deliveries and those who deliver cigarettes and smokeless tobacco. This includes snus, guys! As snus is sold primarily over the internet (unless you're lucky enough to have General sold in your area), if this goes through the Senate we will not be able to buy snus over the internet any longer. Freaking out yet? I know I have been. Many people in my close circle have already stocking up, and I'd be lying if I said I haven't been doing the same.

    So what now? The next meeting of the Senate is 1 Jun 2009. (Monday). The Senate version of this bill (S. 1147) was introduced by Herb Kohl, a Dem from Wisconsin. The current status/last action? May 21, 2009: Read twice and referred to the Committee on the Judiciary, which has 19 members. The members:

    What can we do? ACT! Get emails out to not only these people specifically, but to your local senators as well! http://www.senate.gov/general/contac...nators_cfm.cfm has a list of them, do something! Write letters, make phone calls, send emails. It's in committee now. We need to do something. Tell them your story, let them know about snus as a harm reduced tobacco, and that we will NOT STAND for Taxation Without Representation!

    This is definitely going to suck when it passes (looks like it will be the huge majorities that are voting for it!)

    getsnus.com is a fairly short drive from me. I'm just praying that they do in person retail sales if this shit happens. Otherwise, I'd say I'm pretty well ****ed and will have to go back to smoking, which I REALLY don't want to do!

      Well hopefully it will do some good. Being from SC, I sent an email to Lindsey Graham who is on the Commitee.

      What was the last name of that guy from NY? Anthony D.....Exactly!!!

          Finally, instead of constant whining about it, DO something!!!

          chadizzy1, thank you for doing ALL that legwork, you are now "officially" forgiven.

          Folks, especially if any of the folks on the committee is YOUR Senator, please, please take the time to write a well thought out letter explaining to them why this is a bad idea. Tell them your snus story, how it helped you quit smoking. If you know anyone who lives in states these Senators represent, get them to write too. It is amazing what a bunch of well thought letters really can do. It might just get some of these guys to think twice about what this really means.

            Here we go again

            I wonder why it is that one of these stupid reps will not truly research a product before they decide to ban it. I understand the tax thing, but if you kill the golden goose what do you tax next. I think most of us would pay taxes if they were fair. How many people have quit smoking due to using snus? I did. Now they want to screw with it. The word hypocrite comes to mind. As I said before, LET'S ALL MOVE TO SWEDEN! A snus commune. I am sure some of these snus companies need english speaking people. (I judge that on the fact, I have never received an email answer from any of them ha!) Keep the faith and keep snussing.

                Really hope the Camel/Marlboro execs didn't pay off some corrupt politician to put forth this bill to throw a huge road block in front of any competition they may have had with their U.S. version of snus. Thousands of people will try the Camel/Marlboro brands and then after doing a little research, will get the Swedish version. They won't have that.

                Ok, this is sounding like a Robert Ludlum novel now, I will stop.

                  Pact act blah blah...just old news.This can not and will not pass. It is not legal to curb the sale of a legal product like tobacco through the mail. The Senate will agree. Tons of companies will be put out of business, and will just make the economy worse. If anything, they may attempt to ban tobacco sale into the country through the mail as mail order companies based in the US are already subject to taxes.

                  Bills like this get thrown up all the time. I find it silly and something I wouldn't think twice about.

                    I have always agreed with you. This type of Bill ALWAYS has a much harder time in the Senate than the house. Honestly, why our forefathers set up both a Senate and a house, as they assumed the house would always be more responsive to the rabblerousers. I really do agree that i don't *think* this will pass the Senate.

                    However, it passed OVERWHELMINGLY in the house. Hardly any Democrats OR Republicans voted against it. So that many reps don't care about folks losing their jobs?? In the middle of the worst recession in at least 20 years??? Clearly, THEY didn't see it the way you or I do. And I really would rather just some smart, educated, passionate folks take some time and write the Senators. Let's at least make known our position, and why it is such a big deal to us.

                    What, it will take all of 10 minutes?? And it can't hurt, but just might help.

                      exactly, better safe than sorry. if it takes an extra 10 minutes for us to write a few letters, make a few phone calls, let's just do it. it's either that, or we go back to klondike snus or camel snus. and i really don't want that.

                          Like 160 Republicans voted for it in the house, only 9 Republicans voted against it. This was a freakin bipartisan bill. Get over it!! !!!
