    New smokeless tobacco tax proposal rises on youth marketing fears

    HARRISBURG - Two House lawmakers are touting new proposals to levy a state tax on smokeless tobacco and cigars as a way to counter tobacco industry efforts to market new products to youth.

    The sale by tobacco companies of brightly packaged tablets and pouches containing finely crushed tobacco is part of an effort to create a new youth market for smokeless tobacco, said Reps. Eugene DePasquale, D-95, York, and David Frankel, D-23, Pittsburgh, Tuesday at a Capitol press conference.

    "The new products are easily concealed, spitless and smokeless," added Dr. Samuel Monismith, a member of the Pennsylvania Division of the American Cancer Society, which supports the new legislation.

    As examples, the cancer society cites such products as Camel Orbs, which resemble tic-tacs, and Camel Sticks, toothpick-sized sticks that dissolve in the mouth.

    By being the only state not to tax smokeless tobacco, Pennsylvania is sending youth a message that it's all right to buy these products, said Mr. DePasquale.

    "We are in a sense saying 'We in Pennsylvania think it's OK,' " he said.

    Mr. DePasquale estimated his tax legislation would generate $60 million to $90 million annually. He proposes dedicating half of the revenue to restoring state funding to programs that provide screening for breast cancer and cervical cancer, and urge people not to use tobacco.

    The criticism leveled by anti-smoking groups against youth-oriented smokeless tobacco products offers a new twist to last year's debate over whether taxes on cigars and smokeless tobacco would hurt the state's tobacco growers and several cigar plants.

    Taxes on cigars and smokeless tobacco were part of a budget bill approved by the Democratic-controlled House late during a 101-day deadlock. The Republican-controlled Senate balked at those taxes. The final budget increased the state cigarette tax by 25 cents per pack and included cigarellos or "little cigars" under the definition of the cigarette tax.

    Critics are trying to use a broad brush to say the entire tobacco industry is marketing new smokeless products aimed at youth, said David Sutton, spokesman for Richmond-based Altria Group Inc., parent firm for Philip Morris USA, United States Smokeless Tobacco Inc. and John Middletown Inc., which has a cigar plant in Pennsylvania. Marlboro Snus, the new product introduced by Altria, doesn't dissolve in the mouth, he said.

    "These (Snus) products are not designed for anyone who is underage," said Mr. Sutton. "Snus is a tobacco leaf product in a pouch. It is designed to be put next to the cheek and chewed by adults."

    A recession is not the time to place new taxes on tobacco users, he said.

      Most "kids" smoke Marlboro Reds, or Newports. And they usually get them from their parents. A teen would not be smoking Tourney, or bargain brand.

        So tired of hearing this t... Kids don't want to use snus. They want to smoke cause they think it's cool. If they do want to use snus instead, they're very smart kids.

          Yea, not sure how snus has the social aspect that made smoking attractive when I was a kid.

                This is a huge disappointment. I'm not surprised though, my state is slowly turning into NY. Soon taxes wil be through the roof

                  Very creepy... And very inappropriate for a govt agency.

                    I read something about this last week, it's somewhat disappointing, but not surprising. It's another case of politicians covering their asses, to make certain they have a chance to get re-elected.

                            Really depends on where you are though. In NY, kids don't dip, because hardly anyone does around here, so it's not cool but cigarettes are. When I was in Maine, all the kids were dippers because most people up there dipped, so smoking wasn't seen as cool. Snus isn't really prominent in the public's mind right now, so I don't think we have to worry about it becoming cool, but if you get an area with enough adults doing it, kids will notice and some of them will copy it.

                            I think more could be accomplished to reduce tobacco use amongst kids with proper education than with the current scare tactics and insane taxes/legislation. I mean, yeah if you tax it high enough 99% of kids won't be able to afford it. At the same time, it's unfair that I can't afford my chosen legal vice as an adult because others can't be bothered to take responsibility as a parent. Give kids a reasonable education on the topic, and start teaching it earlier. Have that class in sixth or seventh grade rather than ninth, and tell them the truth. Right now, the schools around here (which are fairly typical for NY schools) basically tell you that if you start to smoke/use tobacco, you will die, and it's going to happen almost as soon as you start smoking your first cigarette. They only hurt their own argument with these tactics, because even a fifth grader can say "Wait, you say you die right after you start smoking? My dad started when he was 15, he said, and he's 35 now, so....... I'm going to have to call BS!" And then even the good parts of the message aren't taken as seriously. It's actually pretty funny that this allegedly very educated people creating these courses are making the exact same mistakes they made with drugs, which was the exact same mistake they made with sex.

                              I sometimes wonder if anti-tobacco zealots have entirely forgotten they were ever teenagers. A teenagers job is to:
                              A. Be cool at virtually any cost.
                              B. Relentlessly push against the boundaries set by parents and authority figures.
                              C. Seek out and obtain whatever seems cool by any means fair or foul regardless of any potential harm.

                              People who think this basic nature of teens can be legislated away are, well, fools. In the case of snus it's my opinion that for every snus portion a kid may use it represents between two and five cigarettes that kid did not smoke. We know that snus is not a gateway to smoking for non tobacco users and although in a perfect world nicotine addiction might be undesirable it is in fact this imperfect world in which we actually live. Not that we should be encouraging the underage to snus but I see little need for chicken-little squawking, garment rending, and noisy hand-wringing over the fact that some kids might indulge. A small percentage of kids who snus is wildly preferable to one that smokes--period. Zealots insists there is no evidence that snus does not lead to smoking. This is a blatant lie of course but even if it were true it is a logical fallacy of the first order to assume that, based on the same lack of evidence, that snus does lead to smoking.
