Currently illegal to mail/internet order ANY tobacco in UT

    Hello fellow snusers!

I was recently reading about the PACT bill and wanted to get some more information about what was going to happen if it passed, so I called my local tobacco store and asked if the guy new anything about the PACT bill. He said, "federal or state"...

I said, "well, I guess federal, I didn't know there was a state bill". He said, "Yes there is, and it passed in May. It is currently illegal to order cigars on the internet"

I did some research and I found this little beauty:

    http://le.utah.gov/~2009/bills/sbillenr/sb0228.htm

Yes, it *is* currently illegal to make possible the sale of *any* tobacco product over the internet, by phone order, or by mail order. To violate this is a class C misdemeanor on the first offense. Governor Huntsman did in fact sign this bill, and it is currently in effect.

Now, I've read this bill a few times, and it says that a standard carton of cigarettes or a "multiple container package" of smokeless tobacco do not count. I'm not 100% sure, but I believe that this means it's legal to order in bulk?

It doesn't really say anything about the buyer... so I'm not sure what the deal is with that.

I was confused and wanted some clarification of the bill, so I called Governor Huntsman's office and asked, and they told me they weren't going to give my any interpretation of it. The "nice" lady on the phone told me that I should listen to the recording of the proceedings that led up to the bill if I needed any clarification.

Meanwhile, I've talked to my local tobacco store owner (this store sells limited amounts of General snus). He told me that he'd order any flavor of snus I want and he'll only charge me shipping. I guess it's not all bad, it's just a lot more annoying.

We were aware of this bill and talked about it here. Are you sure it passed. I had heard it was introduced but had not heard that it actually passed.

Wow, just did some more research and it appears it did. Sorry for folks who live in Utah. But you live in Utah, wth did you expect??

Well, it just seems like this is the beginning. WA to follow on the 26th, and the PACT bill is out there.

The Utah bill is very poorly written:

This bill makes it a violation subject to civil penalties to cause tobacco products to be ordered or purchased through the Internet or by mail.
It almost sounds (and this may just be wishful thinking) like they made it illegal to make it possible to purchase tobacco via mail or internet. Does this mean it's just illegal to create an online store that sells tobacco and is based in Utah?

Do you happen to have the URL of the other thread? I did a search prior to posting this just to make sure and I couldn't find it.

edit: nevermind, I've found it. Sorry for the double post.

Meaning I won't be able to order from Northerner in Washington after July 26th? Man, I really did start this too late LOL

Do you have a source for this?

              Thanks...CoderGuy

Great... I've already ordered snus, before I knew about this law. This is ridiculous. If they have to report back to the state, who gets in trouble? Me, or the stores I bought it from?

I haven't really found a "legal" way to get anything other than General brand snus in Utah.

Originally the people at the Tinderbox told me they would order me any kind that I wanted, but they've since changed their minds on that. They did say that snus is pretty popular there, so, maybe when SM notices that people like snus, they'll distribute a bigger selection in the US.

Hey synic (love the name by the way),

Yeah, it sux. Clueless smokeshops are what's killing me. Most don't even know what Swedish snus is, only Camel SNUS. The one that does know carries General white and wintergreen. I guess that's better than only Camel, but at 8 bucks a pop I will be snusing less. Going to definitely miss the 10 cans for 26 bucks pricing <sigh> oh well.

Snus has been around for 200 years, and I pick the week it becomes illegal to order to start LOL

Do you have any Speedway or Super America stores? Maybe you can find some local Tourney or Grand Prix snus? I know it's not the best, but I could deal with it if that was all I had. It's better than candy snus, at least I think so. Is Triumph still around? I never saw that.

We have two shops that sell General (and currently General White Portion is my favorite anyway). We can get Swedish snus, but it's pretty limited and very expensive.

A roll of General White Portion costs me $45 at Jeanie's Smoke shop.

                            Synic,

After quickly reading the copy of that bill i really get the feeling this is intended for the retailers themselves... Especially after reading lines 95 and 96..

Maybe this is just wishful thinking, as i am from the beehive state myself.

I have been receiving orders regularly and until i hear anything negative i am willing to take my chances.. A class c seems to be a slap on the wrist compared to going without my snus fix!!

Keep me posted if you hear anymore news and I(and hopefully others from around these parts) will do the same!

                              Welp.

At least I've found that I'm not the only snuser in Utah, haha. I wonder what it would take to start your own shop...
