Hate it when people argue on forums.... just can't stand it.....
At least on forums there shouldn't be any hate....

And I dislike forums whose users feel the need to avoid any sort of discussion or debate. It allows people to steep in their own ignorance.

I'm not a fan of deceptive or overly aggressive business practices. But remember Snuscentral sells snus too, so his complaints have their own embedded bias. Both Northerner and MaKe WeBo suffer from our inability to pay taxes and shipping. His points are valid in that I think Northerner could be a bit more competitive price-wise to combat their state tax collection. Then I'd never order overseas again (not that I am now, I can't afford or need another $100+ snus order at the moment).

So the question is does Snus Central own the trademark? and in what countries? Snus is an international buisness.

Snus Central does not sell to countries in the EU.

I'm no legal expert but I could make the case if Larry wanted to claim rights to the Snus Central name in the EU, and does not sell to the EU, he'd be the one guilty of cybersquatting in the EU. Now if someone has the right to use the name Snus Central in the EU, wouldn't they also have the right to register snuscentral.net?

as far as Trademarks in the US you can do a search here: http://www.uspto.gov/trademarks/index.jsp

searching for SnusCentral as a trademark comes up empty, (that doesn't mean they don't have one though.)

That is A question for some of us, for LX it doesn't matter because if it wasn't registered, it wasn't property despite the fact that they are using the same name with a different extension. At least that is the impression I get.

It depends what company sold the domain name, and it could be something for the US courts considering 11 of the 13 DNS servers are in the US.

I wonder if Larry has experienced what we have seen on this form ourselves. Remember before PACT..............60 Minutes had just come out with their story on snus and the forum was hopping with new members..............Pact killed a good deal of that enthusiasm.................and I'm sure with it a great deal of sales. I wonder if Larry is not frustrated from a business stand point and needing to find something to blame....................Obvious choice is His largest competitor Notherner who is stealing all his busness...............and snuson who is stealing all his forum members.......................and well damn................they are practically one in the same.

This might just be due to frustration and a need to lash out.


Now as far as buying up domain names........................like I tell my kids.....................if you don't want someone to steel your bike....................make sure you don't leave it laying around where they can pick it up........................if you do...........don't come crying to me.

I am well versed in domain rulings and trademark law pertaining to domains. having lost a couple battles in the past.

First of all, SnusCentral does not have to register a trademark for it to be valid, they only have to operate with that business name and establish a presence. Having a registered trademark only helps make the case, but is not an automatic trump card. In other words if you or I were to go register the trademark SnusCentral today, we would still likely lose a court battle as SnusCentral can document that they were in business before we trademarked the name.

However having said that, your trademark is really only as good as your money. Do you have the cash flow available to beat down your opponent in court until they give in. These trademark battles are won with dollar bills paid to lawyers, and not so much facts. The facts are irrelevant if you can afford the right legal team.

So if SnusCentral had enough money(I highly doubt) and a good legal team, they could own SnusCentral.net in the end. In my opinion though the costs far outweigh the benefits of owning that extension presently. The future of snus in the US is sketchy at best. So I cannot see any real future value in holding the .net extension anyway. While it was a dick move for the Northerner team to purchase that extension, it was in no way illegal.

I wouldnt stop shopping somewhere because they purchased a competing domain .net extension. I buy on price and shipping speed. And in that area, for my purposes, that is not northerner. When northerner is the cheaper option, I will buy from them. I dont care if the warehouse is in Sweden, USA, or China... I will spend my dollars where they go the farthest. And if that week happens to be Northerners, they will get my vote.

I really don't care about all the finger-pointing and squabbling as long as I have my upper lip full of my favorite snus!

Despite his biased complaints he does make valid points w.r.t Northerner's not as competitive pricing.
