I would think the following would apply here:
Maybe even Drug Testing | American Civil Liberties Union.

Or any one of the sundry Key Issues.
Not at all, what I am saying is the general public doesn't care about fat people or tobacco users. I know several people that have the attitude, "well they could lose weight, not my fault they are fat slobs" and they have a much dimmer view about tobacco users and make no distinction between smoking and snus.

I had a feeling that was the point you were making but my main curiosity is with the ACLU. Maybe this issue, though, is not as headline-grabbing as some of their other key issues; especially in light of the sheep mentality that is so widespread in the country today. The ROI would be far from satisfactory.

Normally I would side with companies right to make sure they are getting productive workers, however in the last 30 years or so we have moved into the information age, and companies can do many things I perceive as illegal. One of them is what this thread is about, testing for legal drugs, and banning or fining for the use of them. What business is it of my employer if I use a legal drug?

The other thing the information age has brought about is credit checks, many times for an entry level position. I refuse to work for a company that invades my privacy in this matter. Sure if I am signing checks for my employer they should have every right to do a credit check, background check etc. However if I am just a schmuck working on some spreadsheets and have no access to cash or accounts, my credit has no bearing on my position.

At what point do they stop, will they next pull my health records and see if I have ever had a particular illness and refuse employment based on that... Sorry Mr Jones, but back in middle school you got mono from kissing Sally Bucklesnort so we cannot in good conscience offer you a position as a janitor in our company. Well we can but you have to accept half pay as you are an insurance risk.

But sheeples always buckle to the powers that be, and make it hard for those of us wishing to stand up against minor tyrannies. Such is life.

You were warned that this would go on your permanent record.

All good points. I remember a news story about a lady being denied an insurance claim because she failed to list her teenage acne as a preexisting condition. A lot of that bullshit got fixed in the health care reform law.

Curious, now that the FDA is regulating tobacco, is this company's policy even legal?

Lol @ NonServiam. It's all about cops advocating the use of false urine purchased at bong shops.

If this was me, I think I'd say I don't use, and use anyway, and when they wanted me to take a urine test, I'd quit.

Sorry, but in today's economic climate that's easier said than done.

Then I would go the gum route, while still using, saying you use nicotine gum. How would a urine test know the difference?

In addition, we have a form we have to fill out that asks whether or not we use tobacco. If we say yes, we have to pay an extra $50 month on our health insurance. If we say no, we're subject to random drug testing for tobacco. If we say no on the form but test positive, we're guaranteed disciplinary action.
It's damn aggravating for a snuser. I can easily snus at work without anyone ever seeing it, and I know I don't have to worry about the same health concerns that a smoker would.

So I guess it's either time to quit or to dish out the extra $50 and say F*** em. If it's the latter, I can guarantee you I'll still use my snus at work.

You may consider if you quit your job to picket against their policy of discrimination.
Create some signs of fat people and ask if they will count their employers calories next.

                        Sheeple Shoes

Just like the over-sized clown shoes that politicians
should be made to wear, especially when they're
                        voting on nanny-state issues!!

Please. This policy was created under one Republican administration, and confirmed under another.

Companies love to dictate morality through discriminatory hiring/firing practices. They already do this to drug users.

                                And...

                                http://www.ddetox.com/product_1939.html

BAM. Solved that problem, on to the next one. I feel like a superhero today.

EDIT: I work in the 1950s, as far as I can tell, and literally everyone around me chain smokes. All I am saying, I guess, is that that a little bit of tobacco moderation would be nice, from my standpoint. Please do not take this as me saying that I think your employers actions are anything less than complete and total horseshit.
