Normally I would side with companies right to make sure they are getting productive workers, however in the last 30 years or so we have moved into the information age, and companies can do many things I perceive as illegal. One of them is what this thread is about, testing for legal drugs, and banning or fining for the use of them. What business is it of my employer if I use a legal drug?
The other thing the information age has brought about is credit checks, many times for an entry level position. I refuse to work for a company that invades my privacy in this matter. Sure if I am signing checks for my employer they should have every right to do a credit check, background check etc. However if I am just a schmuck working on some spreadsheets and have no access to cash or accounts, my credit has no bearing on my position.
At what point do they stop, will they next pull my health records and see if I have ever had a particular illness and refuse employment based on that... Sorry Mr Jones, but back in middle school you got mono from kissing Sally Bucklesnort so we cannot in good conscience offer you a position as a janitor in our company. Well we can but you have to accept half pay as you are an insurance risk.
But sheeples always buckle to the powers that be, and make it hard for those of us wishing to stand up against minor tyrannies. Such is life.

Curious, now that the FDA is regulating tobacco, is this company's policy even legal?

EDIT: I work in the 1950s, as far as I can tell, and literally everyone around me chain smokes. All I am saying, I guess, is that that a little bit of tobacco moderation would be nice, from my standpoint. Please do not take this as me saying that I think your employers actions are anything less than complete and total horseshit.
