I don't think toque should register, and I think we should all stop acting like mindless automatons and begging Roderick to do so.
I am speculating to some degree, but I believe that this is primarily a question of principle to the folks at Toque (not a question of whether or not they could bend to the will of the big bad US gov't, but a question of whether or not they should). I applaud them for ignoring what is an arrogant and invasive piece of legislation, and one that, by all possible modes of logic, should have absolutely nothing to do with them.

What my esteemed lawyer, Snusdog, is saying is that before we jump in the wrong direction we should be cautious till we know how the land lays. If we need FDA registration then we'll get it (should be easy if they don't panic about flavoured/sented tobacco). Right now Royal Mail are advising we do nothing until we have to.

Whatever happens, I hope it all works out Roderick. One thing that makes FDA approval appealing is you'd get the American market almost completely to yourself. I'm not sure what that means in the case of snuff. I honestly don't see it ever being more than a niche, but you never know. A partnership with Northerner could get you into a bunch of stores. I don't know how the advertising rules apply to tobacco shops, but a colorful display board could get people interested in your snuff.

I think Toque would overtake Poschl in the states, if their snuffs were at the tobacco shops that carry Poschl. If they had a nice, yet simple box, maybe like the Dean Swift boxes, and a counter top display like Ozona, that showed the bright Toque logo, I think it would draw attention.

This brings up an interesting point which may cast a little light on Toques hesitancy to do the mammoth work necessary to comply with the FDA. Tom talked of Toque "overtaking Poschl in the states". However it appears the race itself has been canceled. One thing I did no realize (nor do I think the law makers realized it either) is the defacto exemption they gave pipe tobacco. It is simply not mentioned by the law and therefore not included under its restrictions. Therefore, all the pipe shops are simply going on with business as usual (and rightly so).
Now here is the relevance: These shops are all unloading their snuff, dip, RYO and snus because these products (and not pipe tobacco or cigars) require the collection of state taxes. In other words, to carry even an FDA approved snuff would require a mountain of paper work that otherwise these stores will avoid by simply discontinuing the product and sticking to pipes and cigars.
Case in point read this blurb from Mike's News letter over at Mars Cigars & Pipes
The point of all this is- As of right now Getsnus seems to be the only store in the USA that might (and I stress might) be open to selling nasal snuff over the internet since they will already have to comply with state tax collection. However, as of now even Getsnus does not sell snuff.Snuff Corner-

be able to take internet or mail orders for snuff. Due to new federal law (PACT
Act), the shipping of snuff now requires burdensome requirements including charging

The result is that Roderick's mammoth effort to comply with the FDA will yield him at best 1 store in the whole country willing to carry his product with the great likelihood that that number WILL REMAIN at the current 0.

Of all the shops in the United States that sold nasal snuff pre Pact Act....................only two remain...........Nicotine Rush and Mr. Snuff

Dog, what I had in mind was B&M shops. Northerner's gonna be much bigger than internet sales in the coming years. If Roderick got in with them, he could have a ready method of getting his product in stores. I think snus will get fairly big(as far as oral tobacco goes) in the future, and if the snus supplier also happens to carry snuff, it would make it easy for the shops to try it out. A colorful display(assuming it's legal) would draw customers to try it.

I would not disagree with that at all. However.............given that compliance is not time restricted and thus can be done at any time, I would wait until N had those plans in more actualized terms. In the meantime I would (a) see if the marriage with Northerner is a possibility (b) legally solidify the agreement (c) establish a working time frame of when Northerner's new phase is actually going to take place and (d) determine a concrete event within Northerner's implementation that will indicate when Toque should begin it's compliance work (when x happens Toque begins the process).
From my perspective I would need to have more than "a great idea" or a "fantastic scenario" to invest the resources that compliance would require. I would also like to see the numbers comparing B&M sales verses internet sales in the USA to see if even exclusive rights to 1000 US stores nation wide would move the volume that an equal investment in internet sales would yield.
At the same time, I am not throwing a proverbial turd in the punch bowl. If traditionally B&M sales of snuff in the USA show merit of investment, then to not move would be foolish.
