I'd like to see how they decide that one. Pedestrians have the right of way to an extent. But he was jaywalking, and didn't use the crosswalk.

Then again, the ice cream man obviously should have seen him. The guy didn't exactly dart out in front of him. But, on the other hand, doing a boogie-woogie in the middle of a busy roadway is just an invitation to get your grill knocked off by.....well, an actual grill.

Gettin' your groove on in the middle of traffic is usually a self correcting problem! I've watched this probably a dozen times in the last hour and I swear I LMAO everytime!

I would hope so. We live in such a litigious society these days that we award stupidity with bags full of cash.

Although, attorneys like to go for deep pockets. Unless that ice cream truck is owned by a successful company (which it doesn't appear to be given the paint job!) they won't get much out of that deal.

Unless they try saying the city was negligent in not affording a proper crosswalk or the foliage along the roadway obscured driver and pedestrian vision.

Most cities would rather settle out of court, which is cheaper than the litigation fees. These days, the idea of principle, is no longer with us.
